Un fiscal pidió que se anulara el sobreseimiento a De la Rúa
Germán Moldes argumentó que el ex presidente “conocía o debía conocer” los incidentes con muertos y lesionados que precedieron a su renuncia el 20 de diciembre de 2001 y que si bien tenía el poder para evitarlos “no lo hizo”. El fiscal de la Cámara Federal señaló, además, que las razones esbozadas para dictar el sobreseimienmto equivalen a “avalar el mito de la eterna siesta presidencial de quien resulta aquí imputado”.
Para el fiscal los hechos que entonces se registraron en inmediaciones de la Plaza de Mayo y el Obelisco “no podían ser desconocidos por quien dirigiera en ese momento el fatídico destino de la ciudadanía” argentina. “Resulta inadmisible sostener que Fernando de la Rúa no conociera los acontecimientos que sucedieron luego de las 22:41 horas del aquel 19 de diciembre de 2001, en que anunciara por cadena nacional el estado de sitio”, añadió.
Moldes afirmó que “la existencia de funcionarios ineficaces, los informes disfrazados sobre los acontecimientos, la existencia de reuniones para mantenerse en el cargo, no justifican en modo alguno la desvinculación del máximo responsable de la situación generada avalada por una intencionada miopía sobre los hechos”.
Moldes recordó que “el volumen de las manifestaciones espontáneas por parte de la ciudadanía durante esa noche y la madrugada del 20 de diciembre, denominado ‘cacerolazos’, le imponían cuanto menos indagar sobre el desarrollo de las mismas y el consecuente despliegue policial”.
El fiscal ante la Cámara concluyó que De la Rúa “inobservó los deberes de vigilancia ante una acreditada situación de riesgo instaurada por el estado de sitio” del cual el ex presidente “resultaba garante en última instancia”.
